Are you an immigration attorney?
No, and I don’t give legal advice. I write the business plan and financial model supporting your application. Your attorney handles eligibility, treaty country qualification, source of funds and the filing. Many of my clients come referred by their lawyer.
Why five years of projections and not three?
Because marginality is assessed on the enterprise’s capacity to generate more than a minimal living within roughly five years. A three-year plan leaves the officer to guess at the exact period that matters most.
What is the marginality analysis?
It’s the section that addresses whether your business does more than support you and your family. I cover it on both available grounds: income available to you against the minimal living standard, and jobs created for U.S. workers with wages and hire dates. The two are shown independently so neither
Is there a minimum investment for E-2?
There’s no fixed dollar minimum. What matters is proportionality — your investment measured against the cost of establishing or buying that particular business. A $90,000 investment in a $95,000 business can be substantial; $400,000 in a $4M business generally isn’t. I include a proportionality sect
I’m buying an existing business or franchise. Can you handle that?
Yes — that’s what the Premium package is built for. It covers purchase price allocation, proportionality against fair market value, franchise transfer, staff retention and transition planning.
Will you state my country’s poverty guideline or my source of funds?
No. The poverty guideline is republished every January, and source of funds is a legal determination. Both are flagged for your attorney to complete at filing. An outdated or invented figure in a visa file is worse than a marked gap.
Can you guarantee visa approval?
No, and be wary of anyone who does. I can guarantee a complete, internally consistent, well-evidenced plan. The decision belongs to the consular officer or USCIS.
