What happens if the USPTO rejects my application?
You will receive an office action outlining the reasons for rejection. Responses to non-substantive office actions are included in the Standard Package.
What is a non-substantive office action?
A non-substantive office action is an initial rejection letter issued by the USPTO examining attorney that raises procedural or administrative issues related to a trademark application, such as requirements to amend the description, adding disclaimers and/or providing better evidence of use.
What is a substantive office action?
A substantive office action indicates that the examiner has concerns that go beyond formalities with the application, such a that the mark is merely descriptive or that it is likely to be confused with another mark. These offices generally require legal arguments and evidence to overcome.
How do I maintain my US trademark registration?
You must file a maintenance application and pay a fee between the 5th and 6th years and between the 9th and 10th years after registration to maintain your trademark rights. Please ask about my trademark registration maintenance services.
What is an international trademark application?
An international trademark registration allows trademark owners to register their trademarks in multiple jurisdictions with a single application. This is done through the Madrid System, which is administered by the World Intellectual Property Organization (WIPO) International Bureau.
