Sì, se il prodotto rientra nel campo di applicazione di almeno una delle direttive sulla marcatura CE. Le sanzioni per chi non marchia correttamente, per chi marchia falsamente o per chi non marchia un prodotto che lo richiede, raggiungono un massimo di 3 mesi di carcere e una multa di 5000 euro.
Cosa comporta la marcatura CE?
Fondamentalmente, la progettazione di un prodotto per soddisfare i Requisiti di Salute e Sicurezza pertinenti alle direttive applicabili, quindi la creazione di un Fascicolo Tecnico e la produzione di una Dichiarazione di Conformità + eventuale marcatura del prodotto con targhetta CE.
