FAQ
1. What is included in the "Draft Response" vs. the "Full Response Package"?
The Draft Response is for simple, non-substantive issues (e.g., proper classification, formality errors). The Full Response Package is for complex, substantive rejections (e.g., Likelihood of Confusion, Prior Art) that require deep legal arguments.
2. Are you a licensed attorney?
I am a specialized legal consultant/paralegal with extensive experience in USPTO procedure and drafting. I do not provide legal representation. This service is for expert drafting and support only.
3. Does your fee include the USPTO filing fee?
No. My fee covers my professional drafting service only. The applicant (you) is responsible for paying all required USPTO fees, such as extension fees or petition fees, directly to the USPTO system.
4. How long will the response draft take?
This depends on the package selected and the complexity of the rejection. Basic and Standard packages typically take 2-3 days. Premium (Full Response) may require 4-5 days for proper research and drafting. I highly recommend ordering well before your USPTO deadline.
5. What documents do I need to provide?
You must provide the full Office Action Letter and your Application Serial Number immediately upon ordering. For Premium packages, you may also need to provide any evidence you have (e.g., Declarations, Affidavits) for integration into the response.
6. What if the examiner issues another Office Action after filing my response?
Further Office Actions are often covered by your original application fee to the USPTO. If you need a response drafted for a subsequent action, that will require a new Gig order, as it is a new project with new arguments.
