I will file your trademark statement of use or extension

A specimen is usually a photograph of a good that bears your trademark for goods. For services, copies of advertising and marketing material showing a direct association between the mark and the services like websites, handbills, posters, leaflets, circulars, fliers, etc.

It means the Examining Attorney reviewed your application and raised no objections to registration and nobody opposed your trademark registration. All that is required from you is to file the Statement of Use.

A Statement of Use is simply a declaration that states that the trademark is being used on all the goods and/or services designated in the application and are available for sale in interstate commerce.

An Allegation of Use is another term used for a Statement of Use. Both terms refer to a required filing for an applicant who applies for a trademark on an "Intent-To-Use" basis.

The SOU must also include: (1) the date on which your trademark was first used anywhere in the US, (2) the date on which your trademark was first used in the US interstate commerce, and (3) a proper specimen for each class showing the actual use of your trademark.

Once a 'Notice of Allowance' is issued by the USPTO, you have six months to submit a Statement of Use from the date of 'Notice of Allowance'.

The government fee for filing a Statement of Use is $100 for each class of goods or services in the application. I will charge $80 for one class and $20 for each class beyond the first.

After the Statement of Use is submitted, the trademark examining attorney assigned to your application will review it. If it meets all of the requirements, it will be accepted, and the USPTO will issue the Certificate of Registration within a couple of months.

If the Statement of Use is rejected, the trademark examining attorney will issue an office action stating the reasons for the rejection and will give you six months to remedy the issue. So, following the requirements set forth by the USPTO is essential when filing the SOU.
