About this Gig
Welcome. I am Barrett W. Francis, a licensed US Attorney (Bar #006829).

- Conduct a Comprehensive Trademark Search (identifying direct hits and hidden similarities).
- Draft the precise USPTO Application text, legal descriptions, and accurate Class codes.
- Draft legal responses to USPTO Office Actions.

FAQ
Will you file the trademark application with the USPTO for me?
No. I provide document preparation services. I will draft the exact legal text, descriptions, and class codes you need. You will then easily copy and paste this information into the USPTO portal to file it yourself.
Why do I need a comprehensive trademark search before filing?
The USPTO does not refund filing fees if your mark is rejected for being "confusingly similar" to an existing mark. My search identifies hidden similarities, saving you time and money before you file.
What is a Trademark "Class" and how many do I need?
The USPTO categorizes goods/services into 45 classes (e.g., Class 25 for Clothing). My Standard package includes drafting the description for ONE class. Additional classes can be added via Gig Extras.
Will you act as my Attorney of Record with the USPTO?
No. Because I do not file the application for you, you will file as an unrepresented applicant (Pro Se). I will not communicate with the USPTO on your behalf.
What is a USPTO "Office Action"?
An Office Action is a letter from the USPTO refusing registration or requesting clarification. If you receive one, my Premium Package provides a professionally drafted legal response for you to submit to the examining attorney.
What is the difference between "In Commerce" and "Intent to Use"?
"In Commerce" means you are currently selling products with the mark. "Intent to Use" means you plan to use it soon. I will draft the appropriate application language based on your current business status.
Do I have to pay USPTO fees to you?
No. Because you are filing the application yourself using the documents I draft for you, you will pay the mandatory government filing fees directly to the USPTO website.
Can I trademark my logo, my business name, or both?
A business name and a logo require separate applications. I usually recommend trademarking the text name first for the broadest protection, but I can draft application text for both if required.
Do you call or communicate with the USPTO examining attorney?
No. I communicate only with you. I draft the legal arguments and responses, and you submit them directly to the USPTO portal.
How long does the USPTO trademark registration process take?
While I will draft your application materials within days, the full USPTO registration process typically takes 12-18 months after you submit the application on their website.
