How much is the filing fee for filing a petition to revive?
The filing fee is $250 to file a petition to revive. There is also a USPTO fee of $125 for an extension of time to file a response. This is not included in the package.
How much time do I have after the application has been abandoned to revive it?
The USPTO says you should do it within 2 months but if you were unaware of the abandonment, you can do it as long as you are still within 6 months of the date of abandonment. After that, it is too late.
What are the chances of getting the petition to revive granted?
It should be 100% if it is within 6 months and the petition is filled out correctly. However, if you screw up on the petition, that is another story. I will make sure that it is successfully filed along with responding to the Office Action that you should have responded to.
How long does it take for you file the petition to revive?
I usually can file the petition to revive along with the response within 24 hours of getting all the requirements from you. However, if it is more complicated response to file, it may take 2-3 days. It depends on the nature of the issues in the Office Action that you didn't respond to.
